The recognition of nature and the environment as subjects of rights, from the perspective of environmental damage pure or impure in Colombia - jurisprudential line

Abstract

El presente artículo tiene como objetivo principal el estudio de los alcance de las diferentes sentencias que conforman hoy un hito jurisprudencial en materia de la protección del medio ambiente y la naturaleza, enfocado en la identificación del daño abordado, puro o constitutivo, como quiera que, diferenciar ello, nos permite identificar realmente que se esta protegiendo, si desde un punto de vista, antropocéntrico, se protege al hombre y su entorno o a la naturaleza como ente propio sujeto de derechos, apartándonos de ese discurso hegemónico, que nos impide adoptar medidas oficiosas para la defensa de estos entes naturales.

The main objective of this article is to study the scope of the different rulings that today constitute a jurisprudential milestone in the field of environmental and nature protection, focusing on the identification of the damage addressed, pure or constitutive, as differentiating this allows us to really identify what is being protected, whether from an anthropocentric point of view, it protects man and his environment or nature as its own entity subject to rights, moving away from that hegemonic discourse, which prevents us from adopting ex officio measures for the defense of these natural entities.
